Philosophy

Our practice is guided by two overarching principles: preventive law and responsive service.

With sufficient forethought and thorough planning, the financial and emotional costs of most legal conflicts are avoidable. We apply this preventive approach to our work for both individuals and organizations. Regular checkups on our clients’ legal “health” are designed to uncover and correct issues before they become difficult and costly problems.

Equally important is the emphasis we place on listening and responsiveness.  Rather than dictating a predetermined course of action, we take our cues from our clients: what objectives they wish to accomplish, in what time frame, and with what resources. We view ourselves as partners striving to become trusted members of our clients’ professional teams.

Beyond checkups, significant life events like the following can be important times to revisit estate and business plans:

                  Marriage Birth of a child
Illness Death
Start up, purchase or sale of a business    Purchase or sale of a house
Change in financial circumstances Change in employment status
Separation or divorce A child reaching age 18
Parents becoming frail

Our clients include individuals in traditional and non-traditional families, sole proprietorships, family owned businesses, executors, trustees, and non-profit organizations.

Integrated Planning

Integrating your legal plans with your finances and insurance coverage is critical when setting up an estate or business plan.  We work closely with you and your accountant, financial advisor and insurance agent to accomplish this integration efficiently.  Reviewing your plan every few years is a good way to be sure you are taking full advantage of changing tax laws and other legal developments.

Estate Planning

Estate planning encompasses more than just a will or trust.  It is a whole process in which you and Ellen discuss your personal, financial and legal relationships.  Then, together, we institute a plan to:
             Care for your minor children
Manage or distribute your assets in case you become disabled or die
Designate agents to make health care and financial decisions if you are incapacitated
Minimize estate, gift and income taxes

Business Planning

Ellen provides legal advice concerning an organization’s formation, taxation, operation, and dissolution.  A thorough evaluation of relevant business or non-profit organization laws helps to prevent litigation and minimize the costs of unnecessary conflict.  Comprehensive estate planning is an integral part of business planning.

Estate and Trust Administration

Administering an estate or a trust involves a thorough knowledge of tax and probate law. It also requires an understanding of the issues facing a family that is often in a period of transition. We are engaged by executors to do probate work, estate and gift tax analysis, and, if the decedent was the caretaker of the family’s legal and financial affairs, to advise family members about how to begin assuming that role. Trustees rely upon Ellen to interpret trust documents and to counsel them in dealing with beneficiaries, financial institutions and others.
